These Terms & Conditions (the "Terms") govern your use of Foldious (the "Service"), including our website, mobile applications, and any related services. By creating an account or using Foldious, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. About Foldious
Foldious is an online platform that provides free and paid photo storage and AI image generation services. We offer 20GB of free online photo storage to every registered user. Additional storage, advanced AI features, and premium tools are available through our paid subscription packages.
You can access Foldious through our website and our mobile applications (available on supported app stores). Certain features may be available only in the apps or only on the web.
2. Eligibility & Account Registration
- You must be at least 18 years old or have legal permission in your jurisdiction to use the Service.
- You agree to provide accurate, current, and complete information when creating your Foldious account.
- You are responsible for maintaining the confidentiality of your login credentials (email and password) and for all activities under your account.
- You agree to notify us immediately if you suspect any unauthorized access to your account.
3. Free & Paid Services
Foldious offers a free tier and optional paid packages:
- Free Tier: Includes up to 20GB of cloud photo storage and access to basic features.
- Paid Packages: Offer additional storage, enhanced AI image generation, templates, and other premium features as described on our pricing page.
By subscribing to a paid package, you authorize us or our payment processor to charge the applicable fees. All fees, billing cycles, and cancellation terms are described on the pricing/checkout pages.
4. Permissions & Data Access
To provide the Service, Foldious may require access to certain information and device permissions, including:
- Email & Password: Required for account creation, login, security, and communication about your account and service updates.
- Uploaded Content: Photos and images you upload or generate using our AI tools, stored securely in your account.
- App Permissions: When using our mobile apps, we may request access to your device storage, camera, and photo gallery to enable photo upload and management.
All data is handled in accordance with our Privacy Policy. We use appropriate technical and organizational measures to keep your data secure.
5. Acceptable Use
You agree to use Foldious only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Upload, store, or generate any content that is illegal, harmful, abusive, defamatory, hateful, or otherwise objectionable.
- Upload or generate content that infringes any third party's intellectual property or privacy rights.
- Use the Service to distribute spam, malware, or other harmful code.
- Attempt to bypass, interfere with, or compromise the security or integrity of the Service.
- Reverse engineer, decompile, or attempt to derive the source code of any part of the Service.
We reserve the right to remove content or suspend/terminate accounts that violate these rules.
6. Your Content & Ownership
You retain ownership of any photos, images, and content you upload or generate using Foldious, subject to any rights granted to third parties (e.g., stock images or models you may use). By uploading or generating content on Foldious, you grant us a limited, non-exclusive, worldwide license to store, process, and display that content solely for the purpose of operating and improving the Service.
7. Service Availability & Changes
We aim to keep Foldious available and running smoothly, but we do not guarantee that the Service will be uninterrupted or error-free. We may update, change, or discontinue parts of the Service at any time, including features available in free or paid tiers.
8. Limitation of Liability
To the maximum extent permitted by law, Foldious and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of or inability to use the Service.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction where Foldious is established, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes.
10. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms or used the Service in a harmful or unlawful manner. You may also stop using the Service and request account deletion at any time.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. In the case of material changes, we may provide additional notice (such as email or in-app notifications). Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes.
